(Published in The Norman Transcript May 10, 2016, 1t) COMBINED NOTICE OF FINDING OF NO SIGNIFICANT IMPACT ON THE ENVIRONMENT, AND NOTICE TO PUBLIC OF INTENT TO REQUEST RELEASE OF FUNDS May 10, 2016 City of Norman, Oklahoma 201 West Gray Norman, Oklahoma 73069 To All Interested Agencies, Groups and Persons: FINDING OF CATEGORICAL EXCLUSION It is the finding of the City of Norman, Oklahoma, that the activities listed below consist solely of activities Categorically Excluded from the Environmental Review Requirements of NEPA in accordance with 58.35(a) and (b) published in 24 CFR Part 58 and that these activities are in compliance with the environmental requirements of related federal authorities. The activities are listed below: Categorically Excluded items subject to 24 CFR 58.5 Tiered Review; site specific review will be completed upon identification of each site: CDBG Residential Rehabilitation Projects; HOME Community Housing Development Organization (CHDO) Activity; HOME Development of Affordable Rental Housing FINDING OF NO SIGNIFICANT IMPACT: It is the finding of City of Norman that the activities listed above, consists solely of activities having no significant impact on the environment: Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record on file at the Office of the CDBG/Grants Manager, Planning and Community Development Department, 201-A West Gray, Norman, OK. 73069 and is available for public examination and copying upon request between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. Those who wish to comment should specify which part of this Notice they are addressing. NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Fifteen days after the publication of this notification the City of Norman intends to request the Department of Housing and Urban Development (HUD) to release Federal funds under Title I of the Housing and Community Development Act of 1974 (P.L. 93-383) for Projects included in B-16-MC-40-0002 and M-16-MC-40-0204 for which the City of Norman has determined a FINDING OF NO SIGNIFICANT IMPACT and also for those activities Excluded from further review under NEPA. It has been determined that such a Release of Funds will not constitute an action significantly effecting the quality of the environment. All interested agencies, groups, and persons disagreeing with this decision are invited to submit written comments for consideration to the City to the address set forth above, attention Lisa D. Krieg. Such written comments must be received at the address specified within 15 days of this publication. All such comments so received will be considered and the City will not request the Release of Funds or take administrative action on the project prior to the date specified in the preceding sentence. The City of Norman will undertake the activities described above with Community Development Block Grant Program funds and HOME Investment Partnership Program funds from its Fiscal 2016 programs under grants numbered B-16-MC-40-0002 and M-16-MC-40-0204. The City of Norman certifies to HUD that Cindy S. Rosenthal, in her capacity as Mayor of the City of Norman, consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Norman to use Program funds. The US Department of Housing and Urban Development will accept an objection to its approval on only one or more of the bases and the procedure described in 24 CFR part 58.75. The City of Norman plans to send the Request for Release of Funds to HUD on or about May 26, 2016 for the grant programs noted in this publication. The US Department of Housing and Urban Development will accept objections to its release of funds and the City of Norman’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Norman; (b) Norman has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD/State grant administration office at Address of that office. Potential objectors should contact HUD/State to verify the actual last day of the objection period. Objections to the Release of Funds on basis other than those stated will not be considered by HUD and no objections received later than 15 days after HUD’s receipt will be considered by HUD. Cindy S.
