Main Street, Noble, Oklahoma, before the City Council to determine whether the condition of the real property located at 1113 & 1115 N. 5th St. Noble, Oklahoma, and more specifically described as: MEDL2 MEADOWLAKE 2 has become detrimental to the health, benefit, and welfare of the public and the community of the City of Noble, or has become a hazard to traffic, or creates a fire hazard to the danger of property. The City Council will consider the following issues: 1.Whether the accumulation of trash or the growth of weeds or grass has caused the property to become detrimental to the health, benefit, and welfare of the public and the community or a hazard to traffic, or creates a fire hazard to the danger of the property. 2.Whether any structure or structures on the property are dilapidated structures which through neglect or injury lacks necessary repairs or otherwise is in a state of decay or partial ruin to such an extent that the structure is a hazard to the health, safety, ore welfare of the general public or whether a vacant structure on the property is unfit for human occupancy due to the lack of necessary repairs and is considered uninhabitable and is a hazard to the health, safety, and welfare of the general public. In accordance with 11 O.S. §22-111, and the Noble Code of Ordinances, Section 8-301, upon a finding by the City Council that the condition of the property constitutes a detriment or hazard, and that the property would be benefited by the removal of such conditions, the agents of the municipality are granted the right of entry on the property for the removal of trash, mowing of weeds or grass, and performance of the necessary duties as a governmental function of the municipality. Immediately following the cleaning or mowing of the property, the municipal clerk shall file a notice of lien with the county clerk describing the property and the work performed by the municipality, and stating that the municipality claims a lien on said property for the cleaning or mowing costs. Any accumulations of trash or excessive weed or grass growth on the owners property occurring within six (6) months from and after the date of this notice may be summarily abated by the City; That the costs of such abatement shall be assessed against the owner; and that a lien may be imposed on the property to secure such payment, all without further prior notice to the property owner. In accordance with 11 O.S. §22-112, and the Noble Code of Ordinances, Section 8-301, upon a finding by the City Council that the condition of the property is detrimental or a hazard and that the property would be benefited by the removal of such conditions, the City of Noble may cause the dilapidated structure(s) to be torn down and removed. The municipal clerk shall immediately file a notice of dilapidation and lien with the county clerk describing the property, finding of the municipality at the hearing, and stating that the municipality claims a lien on the property for the destruction and removal costs and that such costs are the personal obligation of the property owner from and after the date of filing of the notice. In addition to the remedies set forth herein, the City of Noble shall also have the right to exercise any other remedies that might be available to it under Oklahoma law. In support Petitioner would show the Court as follows: 1. Respondent, Bree Angelica Osburne, was involved in a lawful search that occurred on or about March 3, 2016. As a result of this search the seized currency, which is the subject of this action, was discovered. 2. Service by publication should be authorized as the Respondent-Bree Angelica Osburne cannot be located, has left no legitimate address, and no information regarding her whereabouts can be found. 3. Pursuant to 12 O.S. §2004, this Court can authorize notice by publication when personal service cannot be accomplished; service by mail cannot be accomplished; and no credible information regarding Respondent-Bree Angelica Osburne or her whereabouts can be determined. 4. That with due diligence service of notice cannot be made upon the above named Respondent-Bree Angelica Osburne by any other method. WHEREFORE, premised considered, Petitioner respectfully requests that the Court approve service of Notice by publication as there is no other means by which to provide Respondent-Bree Angelica Osburne with legally required notice in this matter and for such further relief as the Court finds just and equitable.
