CJ-2016-251 PUBLICATION NOTICE STATE OF OKLAHOMA TO: THE UNKNOWN SUCCESSORS OF JOYCE ANN ROGERS, Deceased; and The UNKNOWN SUCCESSORS of MICHAEL L. ROGERS, a/k/a MICHAEL LEN ROGERS, Deceased; You are hereby notified that an action has been file din the District Court in and for Cleveland County, State of Oklahoma, in Case No. CJ-2016-251, styled “VICTOR E. COLLETT, et al., Plaintiffs, V. THE UNKNOWN SUCCESSORS OF JOYCE ANN ROGERS, DECEASED, et al., Defendants,” alleging that Plaintiffs are entitled to foreclosure a real estate mortgage on the real property situated in Cleveland County, Oklahoma, to-wit: SURFACE RIGHTS ONLY. Lot Three (3), of HICKORY HILLS AIRPARK, an addition to Cleveland County, Oklahoma, a tract of land that is part of the SW1/4 of Section Seventeen (17), Township Eight (8) North, Range One (1) East of the I.B.M., according to the plat thereof, recorded in Book 13, at Page 84. Said Plaintiffs’ Petition, alleges that you claim some right, title, lien, estate, encumbrance, claim, assessment or interest in and to the above-described real property, adverse to the Plaintiffs, which constitutes a cloud on the title to the above-described real property; and that you have no right, title, lien, estate, encumbrance, claim, assessment or interest, either in law or in equity, in and to said real property. You are hereby notified that you have been sued and must answer the Petition, filed by the Plaintiff on or before the 20 day of April, 2016, or the allegations of said Petition, will be taken as true and judgment rendered against you, awarding the Plaintiff a first mortgage lien upon the property described above, for the sum of $13,500.00, together with interest thereon in the sum of $10,524.45, as of December 31, 2015, and accruing thereafter at the rate of $4.44 per diem, to the date of judgment, post-judgment interest thereafter at the contract rate, until paid; abstract expenses, all other expenses, fees, charges, advances, taxes, assessments, and costs of this action, including a reasonable attorney’s fee, and foreclosing said mortgage lien and ordering said property sold with or without appraisement as Plaintiffs may elect, all of which you will take due notice. In such event, you will be adjudged and decreed to have no right, title, lien, estate, encumbrance, claim, assessment or interest, either in law or in equity, in and to said real property and a decree foreclosing Plaintiffs’ mortgage on said real property will be entered.
