(Published in The Norman Transcript October 14, 2016, 1t) Finding of No Significant Impact and Notice of Intent to Request release of Funds Request for release of funds On or after November 1, 2016, the City of Norman will submit a request to the Oklahoma Department of Commerce (ODOC) for the release of Community Development Block Grant Disaster Relief funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as 16237 CDBG-DR 13 GC0067-GC0068, for the purpose of: Widening (including base stabilization, minor drainage repair, asphalt paving of roadway, private driveway and intersection paving to the right-of-way, and sod for erosion control), and reconstructing when necessary, up to 50 from center the following existing roads in Norman, Oklahoma (Cleveland County): Project GC0067 120th Ave NE Tecumseh Road to Stella Road 4 Miles Project GC0068 Stella Road 132nd Ave NE to 144th Ave NE 1 Mile Finding of no significant impact The City of Norman has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file with Tim Miles of the City of Normans Public Works Department located at 201-A West Gray, Norman, Oklahoma 73069, and may be examined or copied weekdays 8:00 A.M. to 5:00 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to Tim Miles with the City of Normans Public Works Department located at 201-A West Gray, Norman, Oklahoma 73069. All comments received by October 31, 2016 will be considered by the City of Norman prior to authorizing submission of a request for release of funds. Comments should specify which notice they are addressing. RELEASE OF FUNDS The City of Norman certifies to ODOC that Lynne Miller in her capacity as Mayor of the City of Norman consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. ODOCs approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Norman to use HUD Program funds. OBJECTIONS TO RELEASE OF FUNDS ODOC will consider objections to its release of funds and the City of Normans certification received by November 16, 2016 or for a period of fifteen days following its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Norman; (b) the City of Norman has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by ODOC; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the Oklahoma Department of Commerce, 900 N. Stiles, Oklahoma City, OK 73104. Potential objectors should contact ODOC to verify the actual last day of the objection period.
