(Published in The Norman Transcript August 4, 2016, 1t) THE CITY COUNCIL OF THE CITY OF MOORE, STATE OF OKLAHOMA, MET IN REGULAR SESSION IN THE COUNCIL CHAMBERS AT THE CITY HALL LOCATED AT 301 NORTH BROADWAY, IN MOORE, OKLAHOMA, ON THE 1ST DAY OF AUGUST, 2016, AT 6:30 OCLOCK P.M. PRESENT: Glenn Lewis, Danielle McKenzie, Jason Blair, Melissa Hunt, Terry Cavnar, Adam Webb and Mark Hamm ABSENT: None Notice of the schedule of regular meetings of the City Council of the City of Moore, Oklahoma for the calendar year 2016 having been given in writing to the Clerk of the municipality, and public notice of this meeting with an agenda was posted in prominent view at the entry of the City Hall twenty-four (24) hours prior to this meeting, excluding Saturdays, Sundays and designated legal holidays, all in compliance with the Oklahoma Open Meeting Act. (OTHER PROCEEDINGS) THEREUPON, the Mayor introduced an Ordinance which was read in full by the City Attorney, and upon motion by Councilmember Blair, seconded by Councilmember McKenzie, said Ordinance was adopted by the following vote: AYE: Lewis, McKenzie, Blair, Hunt, Cavnar and Webb NAY: Hamm Said Ordinance was thereupon signed by the Mayor, attested by the Clerk, sealed with the seal of said municipality, and is as follows: ORDINANCE NO. 828(16) AN ORDINANCE OF THE CITY OF MOORE, OKLAHOMA, AMENDING SECTION 17-209 OF CHAPTER 2 OF PART 17 OF THE CODE OF ORDINANCES OF THE CITY OF MOORE, OKLAHOMA, BY ADDING REQUIRED BI-WEEKLY RESIDENTIAL CURBSIDE RECYCLING AND ESTABLISHING A RATE THEREFOR; PROVIDING EFFECTIVE DATE FOR SAID INCREASE SUBJECT TO VOTER APPROVAL: AND CONTAINING OTHER PROVISIONS RELATING THERETO. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MOORE, OKLAHOMA: Section 1. Purpose. The City of Moore, Oklahoma (the City) desires to establish a requirement for residential curbside recycling in the City and desires to establish a rate necessary to provide this service. Section 2. Rates. That Section 17-209 of Chapter 2 of Part 17 of the Code of the City of Moore, Oklahoma, shall be and is hereby amended to read as follows: Section 17-209. Rates for sanitation service. * * * For one (1) designated container provided for recyclable materials: (1) Curbside recycling shall be provided bi-weekly for all residential customers at an additional cost of $3.00 per month. * * * Section 3. Effective Date. Subject to approval of a majority of the registered voters of the City of Moore, Oklahoma, voting on same as prescribed by law, to be held on November 8, 2016, the rates set forth in Section 2 hereof shall be effective for all billings issued on or after the first day of April, 2017, and thereafter. Section 4. No Precedent. Although the City Charter of the City permits the City Council to set utility rates without voter approval, the City decided to allow for voter approval of curbside recycling. This in no way shall establish a precedent requiring voter approval for utility rate changes by the City in the future, including any rate adjustments necessary after the first year of service, to continue providing residential curbside recycling. Section 5. Amendments. The people of the City of Moore, Oklahoma, by their approval of this Ordinance at the election hereinabove provided, hereby authorize the City Council by Ordinance duly enacted to make such administrative and technical changes or additions in the method and manner of administration and enforcing this Ordinance as may be necessary or proper for efficiency and fairness. Section 6. Provisions Severable. The provisions hereof are hereby declared to be severable, and if any section, paragraph, sentence or clause of this Ordinance is for any reason held invalid or inoperative by any court of competent jurisdiction, such decision shall not affect any other section, paragraph, sentence or clause hereof. Section 7. Incorporation of Ordinance. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the City of Moore, Oklahoma, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code of Ordinances of the City of Moore, Oklahoma.
