TONY H. MOHAMMADI a/k/a HASSAN TONY MOHAMMADI, a/k/a ANTHONY HASSAN MOHAMMADI and ELIZABETH D. MOHAMMADI a/k/a ELIZABETH DENISE MOHAMMADI, Husband and Wife; JPMORGAN CHASE BANK, N.A. COUNTY TREASURER OF CLEVELAND COUNTY; BOARD OF COUNTY COMMISSIONERS OF CLEVELAND COUNTY; and ANY and ALL TENANTS, if any, Defendants Case No. CJ-2016-76 Judge Thad Balkman ALIAS NOTICE OF SHERIFF’S SALE NOTICE is given that on the 7 day of September, 2016, at 10:00 o’clock a.m., at the Courthouse, the undersigned Sheriff of said County will offer for sale and sell for cash at time of sale, at public auction to the highest and best bidder, with appraisement, all that certain real estate in Cleveland County, Oklahoma, to-wit: LOT SIX (6), BLOCK FOUR (4), OF CHERRY CREEK SECTION 2, TO NORMAN, CLEVELAND COUNTY, OKLAHOMA, ACCORDING TO THE RECORDED PLAT THEREOF. The Real Property or its address is commonly known as 4015 Knob Hill Cir., Norman, OK 73072 subject to any unpaid general real estate ad valorem taxes and/or special assessments which by statute are a first and prior lien, if any, and subject to the first mortgage on the property held by JPMorgan Chase Bank, N.A. in the amount of $60,677.74, plus interest accruing thereon at the rate of 4.875%, with a per diem of $8.06, from July 14, 2016, plus costs and fees. Said property has been appraised for the total amount of $150,000.00, less the sum of the first mortgage of JPMorgan Chase Bank, N.A. at $60,677.74 for a net equity appraisal of the second mortgage of United Guaranty Residential Insurance Company of North Carolina being $89,322.26. A bid of 2/3 of the net equity appraisal is required to obtain confirmation of the sheriff’s sale. Sale will be made pursuant to an Order of Sale issued upon judgment entered in the District Court of Cleveland County, Oklahoma, in the above entitled cause, wherein United Guaranty Residential Insurance Company of North Carolina was Plaintiff and Tony H. Mohammadi a/k/a Tony Hassan Mohammadi a/k/a Anthony Hassan Mohammadi and Elizabeth D. Mohammadi a/k/a Elizabeth Denise Mohammadi, husband and wife, JPMorgan Chase Bank, N.A., County Treasurer of Cleveland County, Board of County Commissioners of Cleveland County, and Any and All Tenants, were Defendants, to satisfy the judgment of the Plaintiff and the lien of the Defendants as follows: Judgment in rem against the Defendants, Tony H. Mohammadi a/k/a Tony Hassan Mohammadi a/k/a Anthony Hassan Mohammadi, County Treasurer of Cleveland County, Board of County Commissioners of Cleveland County, and Any and All Tenants, if any, and for judgment in personam against the Defendant, Elizabeth D. Mohammadi a/k/a Elizabeth Denise Mohammadi, for the sum of $27,200.68, with accrued interest in the amount of $4,358.26 and interest thereon at 7.85% per annum from December 22, 2015, until paid; a reasonable attorney’s fee in the amount of $3,500.00; costs of this action; the total past due amount; the cost to update the abstract and obtain a foreclosure title opinion; and all other allowable expenses and advances for taxes, insurance, property preservation; as well as all necessary funds advanced by said Plaintiff accrued and accruing hereafter through completion of this action.
