(Published in The Norman Transcript May 6, 2016, 1t) PURSUANT TO THE LEGAL NOTICE AS IS REQUIRED BY THE OKLAHOMA OPEN MEETING ACT INCLUDING THE POSTING OF NOTICE AND AGENDA AS IS REQUIRED BY THE TERMS THEREOF, THE CITY COUNCIL OF THE CITY OF NOBLE, OKLAHOMA (THE “CITY”) MET IN REGULAR SESSION IN SAID CITY ON THE 2ND DAY OF MAY, 2016, AT 6:30 O’CLOCK P.M. PRESENT: Mayor Gary Hayes, Gail Hatfield, Tony Parker, Dianne Gray, and Marge Hill ABSENT: None (OTHER PROCEEDINGS) Thereupon, the following resolution was introduced and caused to be read by the Mayor. Councilmember Tony Parker moved passage of the Resolution and Councilmember Gail Hatfield seconded the motion. The motion carrying with it the approval of said Resolution was approved by the following vote: AYE: Mayor Gary Hayes, Gail Hatfield, Tony Parker, Dianne Gray, and Marge Hill NAY: None The Resolution so approved is as follows: RESOLUTION NO. 2016-06 A RESOLUTION AUTHORIZING THE CALLING AND HOLDING OF A SPECIAL ELECTION IN THE CITY OF NOBLE, OKLAHOMA, ON TUESDAY, AUGUST 23, 2016, FOR THE PURPOSE OF SUBMITTING TO THE REGISTERED QUALIFIED ELECTORS OF SAID CITY THE QUESTION OF APPROVAL OR REJECTION OF ORDINANCE NO. 543 OF THE CITY RELATING TO A ONE-HALF OF ONE PERCENT (0.50%) EXCISE TAX (SALES TAX), IN ADDITION TO ALL PRESENT CITY, COUNTY, AND STATE EXCISE TAXES, WITH THE PROCEEDS OF SAID TAX TO BE USED TO FUND CAPITAL EXPENDITURES PERTAINING TO PUBLIC SAFETY, INCLUDING BUT NOT LIMITED TO POLICE, FIRE, EMERGENCY MEDICAL SERVICES, AND ASSOCIATED DISPATCH SERVICES, BENEFITING THE CITY, ALL AS MORE FULLY SET OUT IN ORDINANCE NO. 543 OF SAID CITY; AUTHORIZING A LEGAL SERVICES AGREEMENT WITH THE PUBLIC FINANCE LAW GROUP PLLC FOR LEGAL SERVICES IN CONNECTION WITH THE ELECTION; AND CONTAINING OTHER PROVISIONS RELATED THERETO. WHEREAS, the voters of the City are being asked to approve the levy and assessment of a new one-half of one percent (0.50%) excise tax (sales tax) which is to be used to fund capital expenditures pertaining to public safety, including but not limited to police, fire, emergency medical services, and associated dispatch services, all for the use and benefit of the City and any public trust having the City as beneficiary thereof, and/or for the payment of debt service in connection with obligations heretofore issued or to be issued by the City and any public trust having the City as beneficiary thereof to finance or refinance said capital expenditures and related costs, said tax to be levied beginning January 1, 2017, and having no stated termination date, all as more specifically set out in Ordinance No. 543 of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NOBLE, OKLAHOMA: SECTION 1. That the Mayor of the City be, and he is hereby authorized and directed to call a special election to be held in said City on the 23rd day of August, 2016, for the purpose of submitting to the registered, qualified voters thereof the following proposition: PROPOSITION Shall the City of Noble, Oklahoma be authorized to levy and assess a City excise tax (sales tax) of one-half of one percent (0.50%), in addition to all other City of Noble, Cleveland County, and State of Oklahoma excise taxes presently being levied or assessed, upon the gross proceeds or gross receipts derived from all sales taxable under the Oklahoma Sales Tax Code; providing that the proceeds of such tax shall be used to fund capital expenditures, pertaining to public safety, including but not limited to police, fire, emergency medical services, and associated dispatch services, all for the use and benefit of the City and any public trust having the City as beneficiary thereof, and/or for the payment of debt service in connection with obligations heretofore issued or to be issued by the City and any public trust having the City as beneficiary thereof to finance said capital expenditures and related costs; provided that said excise tax shall be levied beginning January 1, 2017, and shall have no stated termination date; all as more specifically set out in Ordinance No. 543 of the City? /_______/ Yes - For the Above Proposition /_______/ No – Against the Above Proposition SECTION 2. That such call for said election shall be by proclamation, signed by the Mayor of the City and attested by the City Clerk, setting forth the proposition to be voted upon and the hours of opening and closing of the polls. That the ballots shall set forth the proposition to be voted upon substantially as set out in Section 1 hereof, and that the returns of said election shall be made to and canvassed by the Cleveland County Election Board. SECTION 3. The Mayor or Vice Mayor is authorized to execute and deliver a Legal Services Agreement with The Public Finance Law Group PLLC for legal services in connection with the calling of the special election referenced in this Resolution. I further certify that attached hereto are true and complete copies of the notice given to the City Clerk of Noble, Oklahoma, on November 17, 2015, and of public notice and agenda posted at City Hall, in Noble, Oklahoma, at least twenty-four (24) hours prior to this meeting, excluding Saturdays, Sundays and legal holidays, all in compliance with the Oklahoma Open Meeting Act.
