Case No. CV-2015-2136 Judge Walkley NOTICE OF SERVICE BY PUBLICATION You are hereby notified that Plains Pipeline, L.P. (”Plains”), acting under and by virtue of the laws of the State of Oklahoma, has filed legal proceedings, CV-2015-2136, in the District Court of Cleveland County. In those proceedings, Plains is the plaintiff. You are the defendants. Plains, acting under the laws of the State of Oklahoma, has determined it necessary to acquire a fifty-foot wide permanent pipeline easement (the “Permanent Easement”) and a fifty-foot wide temporary easement adjacent to the Permanent Easement (the “Temporary Easement”) upon, over, under and across one parcel of real property particularly described as: The West Half of the West Half of the West Half of the Northeast Quarter of Section 12, Township 10 North, Range 1 East of the Indian Meridian, Cleveland County, Oklahoma (the “Easement Tract”). The Easement Tract is more particularly described in the Petition for Eminent Domain filed in the above-named Court, and previously sent to your last-known address.. The Permanent Easement and Temporary Easement are for the purpose of a right-of-way for transporting hydrocarbons, petroleum products, including oil and gas, and its constituent products, liquids, gases, solids, or any combination thereof, by pipelines, and the laying, constructing, maintaining and operations thereof, along with the additional rights and privileges as described in the Petition for Eminent Domain filed in the District Court of Cleveland County (the “Described Purposes”). Having been unable to acquire the Permanent Easement and Temporary Easement by negotiation, Plains will, on February 16, 2016, at 2:00 p.m., or as soon as possible thereafter, apply to the Honorable Judge Walkley, Judge of the District Court of Cleveland County, State of Oklahoma, at the Cleveland County Courthouse located at 200 South Peters Ave., Norman, Oklahoma 73069, for an Order appointing three (3) disinterested freeholders of Cleveland County, Oklahoma, who are not interested in a like question, to inspect the Property and consider the just compensation to which the Defendants are due by reason of the condemnation of the Permanent Easement and Temporary Easement for the Described Purposes. Those Commissioners who are appointed shall further be ordered to return their report to the Clerk of this Court. The Court Clerk will, within ten days, forward a Notice of Filing and a copy thereof to all parties. Within thirty days after the filing of the report, any party to this proceeding may file a written exception to said report. Within sixty days from the filing of said report, any party to this proceeding may also file a written demand for a trial by jury of the issues involved. If neither party files exception to the report of the Commissioners, nor demands a trial by jury within the time limitations set out above, the report of the Commissioners shall be approved by the Court and the proceedings shall be closed.
